GENERAL TERMS AND CONDITIONS OF SALE

Article 1 — Company Identification
These General Terms and Conditions of Sale are concluded between:

Article 2 — Purpose
The purpose of these General Terms and Conditions of Sale is to define the conditions for selling personalized products offered on the Les Merveilles de Lyse website.
Any order implies full and unreserved acceptance of these conditions.
Article 3 — Products
Les Merveilles de Lyse offers baby and child items selected from specialized suppliers.
These items are personalized at the customer's request by embroidery according to the options offered on the site (first name, font, thread color, embroidery placement).
The main characteristics of the products (material, cut, colors) are those communicated by the suppliers. Slight variations independent of personalization may exist and cannot engage the seller's responsibility.
Article 4 — Personalization and Customer Responsibility
The customer is solely responsible for:
• the spelling of the given name or text provided
• the choice of options (font, thread color, placement)
• the information provided when ordering
No modification can be guaranteed after order validation.
Article 5 — Photos and Product Presentation
The photographs on the site are as faithful as possible.
However:
• Product colors may vary slightly depending on lighting and screens.
• Embroidery renderings may differ slightly depending on the fabric and the length of the first name.
• The example embroideries shown may vary slightly from the final rendering.
• The embroidery threads presented as color charts correspond faithfully to the proposed colors.
These variations cannot in any way engage the seller's responsibility.
Article 6 — Order
Any validated and paid order constitutes a firm and definitive commitment.
A confirmation email is sent after payment validation.
Les Merveilles de Lyse reserves the right to refuse an order in case of a previous dispute with the customer.
Article 7 — Prices
Prices are indicated in euros (€) including all taxes (TTC).
Delivery costs are indicated before order validation.
Les Merveilles de Lyse reserves the right to modify its prices at any time.
Article 8 — Payment
Payments are secured and can be made via:
• Credit card (Visa, Mastercard, American Express)
• Apple Pay
• Shop Pay
• PayPal
The order is validated only after payment confirmation.
Article 9 — Manufacturing and Delivery Times
As products are personalized on demand:
• The manufacturing time is 14 working days (excluding weekends and public holidays).
• To this is added the delivery time depending on the carrier chosen by the customer.
Deliveries are provided to:
France, Belgium, Switzerland, Europe, United Kingdom, and Overseas territories.
Delays attributable to carriers cannot engage the seller's responsibility.
Article 10 — Right of Withdrawal and Order Cancellation
Order cancellation, right of withdrawal and returns
In accordance with the provisions of the Consumer Code, the customer has a legal period of fourteen (14) days from receipt of the products to exercise their right of withdrawal concerning non-personalized items, without having to give reasons or pay penalties.
The right of withdrawal is exercised under the conditions provided by current legislation and implies the return of products in their original and complete condition.
However, in accordance with article L221-28 of the Consumer Code, the right of withdrawal cannot be exercised for goods manufactured according to consumer specifications or clearly personalized.
As such, items offered by the company including personalization made at the customer's request (including name embroidery, choice of font, thread color, pattern or any custom option) are considered personalized products.
Any order for a personalized product validated and paid for is firm and final.
No cancellation, modification, refund or withdrawal can be accepted after payment validation, including if personalization or manufacturing has not yet begun.
The customer is expressly informed that it is their responsibility to carefully check all information entered before validating their order (spelling, chosen options, selected model).
Management fees in case of cancellation or withdrawal
In the event of exercising the right of withdrawal or requesting cancellation concerning non-personalized items, the refund made to the customer may be subject to a deduction corresponding to the management and processing fees incurred by the company.
These fees include in particular:
- bank transaction fees not refunded by payment institutions;
- administrative fees for order and refund processing;
- logistical operations undertaken for the preparation and restocking of the concerned items
The amount of management fees is set at:
• 8 euros per item concerned by the cancellation or withdrawal
This amount will be automatically deducted from the refund made to the customer.
These fees do not constitute a penalty but compensation for the actual costs incurred by the company for order processing.
Article 11 — Right of withdrawal and returns
In accordance with article L221-28 of the Consumer Code, personalized products made at the customer's request do not benefit from any right of withdrawal.
Consequently, no return, cancellation or refund can be accepted for:
- a spelling error attributable to the customer;
- an option choice validated during the order;
- an incorrect selection of model, size or color;
- a simple change of mind.
It is the customer's responsibility to carefully check all information entered before validating the order.
Article 12 — Exceptional Refund
An exceptional refund may be granted by the company, without this constituting an obligation.
Each request will be examined on a case-by-case basis.
In the event of exceptional acceptance of a cancellation concerning a non-personalized item, the refund will be made via the original payment method, less:
- bank transaction fees not refunded by payment providers;
- management fees provided for in these General Terms and Conditions of Sale.
Personalized products can in no case be subject to an exceptional refund, in accordance with the regulations applicable to goods manufactured according to customer specifications.
The company reserves the right to refuse any request that does not comply with these conditions.
Article 13 — Liability
Les Merveilles de Lyse cannot be held responsible for:
• delivery delays attributable to carriers
• address errors provided by the customer
• damage occurring after delivery
• minor variations in shade or material related to suppliers
Article 14 — Intellectual Property
All elements of the site (photos, texts, logo, visual creations, embroideries) are protected by intellectual property law.
Any total or partial reproduction is strictly prohibited.
Article 15 — Personal Data
The information collected is necessary for order processing and commercial relations.
This data is neither resold nor transmitted to third parties.
Article 16 — Applicable Law
These General Terms and Conditions of Sale are subject to French law.
In the event of a dispute, an amicable solution will be preferred before any legal action.
